By accessing or using our services, including our website and SMS messaging platform, you agree to be bound by these Terms and Conditions. If you do not agree, please discontinue use immediately.

2. Use of Services

Eligibility

You must be at least 18 years old to use our services. You are responsible for ensuring that your use of our services complies with all applicable laws and regulations.

Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and ensuring the accuracy of the information provided. Notify us immediately of any unauthorized use of your account or security breach.

Prohibited Activities

You agree not to:

Use our services for illegal or unauthorized purposes.

Violate any applicable laws, including but not limited to SMS messaging compliance and The Campaign Registry (TCR) compliance guidelines.

Send spam, fraudulent, or misleading messages.

Interfere with or disrupt the integrity or performance of our services.

3. Messaging Consent

Opt-In Requirements

You may only send SMS messages to recipients who have explicitly opted in to receive communications from you. Consent must be collected through clear and transparent methods, such as checkboxes or forms, and records must be maintained.

Opt-Out Requirements

You may opt out of receiving text messages at any time by replying STOP or CANCEL to any text message you receive, or by contacting us via email or phone. Upon opting out, you will receive a final message confirming your opt-out request, and your number will be removed from our list within 24 hours. Recipients must be provided with an easy way to opt out of receiving messages by replying with "STOP" or “CANCEL” or similar keywords. Upon receiving an opt-out request, you must cease sending messages to the recipient immediately.

Message Frequency Disclosure

Messages are recurring, and frequency may vary depending on your interaction with our services.

Compliance

You are solely responsible for ensuring your messaging campaigns comply with SMS messaging compliance standards, TCR guidelines, applicable laws, and carrier requirements.

4. Data Privacy and Security

We prioritize your privacy and protect your data using industry-standard encryption and security measures. Refer to our Privacy Policy for detailed information about how we collect, use, and safeguard your data.

5. Fees and Charges

Service Fees

Message and data rates may apply depending on your mobile carrier and plan. Customers are responsible for any charges incurred from receiving SMS messages. SMS messaging services may include fees for message delivery and TCR registration. Fees are detailed during the registration and onboarding process and may include:

$1.50 Monthly SMS registration fee

$15.00 One-time SMS vetting fee

Payment Terms

All fees are non-refundable unless explicitly stated otherwise. Payments must be made on time to avoid service interruptions.

6. Termination of Services

We reserve the right to terminate or suspend your access to our services if you violate these Terms and Conditions or engage in prohibited activities.

7. Limitation of Liability

Easy Peasy Ledger is not liable for:

Losses resulting from unauthorized access to your account.

Interruptions or delays in SMS delivery caused by third-party carriers or unforeseen circumstances. Our maximum liability is limited to the amount you paid for our services in the last 12 months.

8. Changes to Terms and Conditions

We may update these Terms and Conditions from time to time. Changes will be posted on this page, and we encourage you to review them periodically.

9. Governing Law

These Terms and Conditions are governed by the laws of the State of California, United States, without regard to its conflict of law provisions.

11. Additional SMS-Specific Terms

Third-Party Services

We partner with third-party providers to deliver SMS services. By using our SMS platform, you agree to allow us to share necessary information with these providers solely for service delivery purposes.

Message Content Responsibility

You are responsible for ensuring that your message content adheres to all legal and regulatory requirements, including but not limited to TCR guidelines and SMS messaging compliance standards.

Opt-In Data

Opt-in data and recipient consent will not be shared with third parties for any purpose unrelated to SMS campaign support.
